Consider mediation
Instead of costly, time consuming litigation, clients should consider methods of alternative dispute resolution such as mediation. Mediation is a process where a third-party neutral facilitates the negotiations of two or more parties in achieving a mutually acceptable agreement. Participation is usually voluntary, the results remain confidential and the success rate can be rather high so long as all parties participate in good faith. The mediator provides an unbiased yet experienced point of view to help you evaluate the strengths and weaknesses of your case. Although there is a cost associated with mediation, proper use of the method can avoid the filing of lawsuits, multiple court appearances and expensive discovery. Can I sue the government?
The Illinois Local Governmental and Governmental Employees Tort Immunity Act exists to protect local government units and public employees from liability for many acts arising from the operation of government. In general, there is no liability for negligent acts or omissions in carrying out the day to day functions of the government. There are exceptions to this rule including for willful or intentional acts, for violations of government contracts and for violations of a municipality’s own ordinances. Pursuing the right insurance policy
