We recently received another favorable decision from an Illinois appellate court. Our client has been struggling for years to obtain access to a public road for an otherwise valuable piece of real estate she inherited. We filed suit against adjoining property owners relying upon complex case law and precedent which can force access easements in some cases. Our claim was based upon the fact that our client’s predecessor at one time owned all of the surrounding property but had made some inadvertent errors in memorializing how the property was to be accessed. The trial court granted a motion to dismiss the lawsuit. The Appellate Court, in a lengthy opinion, agreed that our client’s claim had merit under the law and should be allowed to proceed forward. We are pleased that we were able to obtain this result for our client.
