If a family member or loved one is killed as a result of the negligent or intentional acts of another person, the law allows the heirs of the deceased to pursue damages arising from the death. Things such as funeral expenses, final medical bills, loss of income and loss of love and companionship may be pursued. Who is entitled to seek this compensation? The law allows the heirs of the deceased to bring the claim. Priority is given to a surviving spouse and children. If the decedent left no spouse or children, grandchildren would have the next priority. If there are no direct descendants, the next priority goes to surviving parents and siblings. Things become much more complicated if there are no surviving parents and siblings but there may still be heirs entitled to pursue a case.
