Our firm recently won an appellate court matter involving the sale and foreclosure of a delinquent real estate tax certificate. The trial court had ruled that the owner of a commercial property should be allowed additional time to redeem his delinquent taxes beyond the strict time periods set forth by Illinois statutes. Our firm successfully argued that the statutory time frames could not be extended except in cases where the property order justifiably relied upon an error by a government official. In this case, the property owner did not pay what he owed because he believed the estimate of redemption to be for an incorrect amount. We were able to get the trial court decision reversed by convincing the court that it was the property owner and not the county clerk’s office that was mistaken. This case will provide future guidance to attorneys and litigants dealing with problems which arise when a last minute redemption is attempted and fails.
